Na <a href=\"https:\/\/www.italpassion.fr\/nl\/stellantis\/stellantis-320-onmiddellijke-ontslagen-en-tot-700-banen-bedreigd-in-de-fabriek-die-alfa-romeo-fiat-en-jeep-produceert\/\">aankondigingen van massaontslagen<\/a> en <a href=\"https:\/\/www.italpassion.fr\/nl\/stellantis\/ontslagen-bij-de-poolse-fabriek-in-stellantis-de-vakbond-schrijft-rechtstreeks-aan-peugeot-aandeelhouders-exor-en-bpifrance-wij-zijn-zeer-teleurgesteld\/\">rechtstreeks beroep op de aandeelhouders van de groep<\/a>Daarom gaan de werknemersvertegenwoordigers nu in de juridische arena in de aanval. De vakbond Solidarnosc dreigt duidelijk met <a href=\"https:\/\/www.italpassion.fr\/nl\/stellantis\/\">Stellantis<\/a> van juridische stappen, het aanklagen van een vastgelopen sociale dialoog en toezeggingen die als misleidend worden beschouwd.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Een collectieve actie tegen het verlies van de derde post<\/h2>\n\n\n\n<p>Op woensdag 21 januari hebben vakbondsvertegenwoordigers van de fabriek in Tychy officieel een class action aangespannen tegen hun werkgever. Het gaat om het besluit om de derde productieschakeling vanaf maart te schrappen. Deze maatregel maakt deel uit van het omvangrijke reorganisatieplan dat begin januari werd aangekondigd en zou kunnen leiden tot het vertrek van ongeveer 740 werknemers, inclusief werknemers met een contract voor bepaalde tijd en tijdelijke werknemers. Voor Solidarnosc weerspiegelt dit cijfer slechts gedeeltelijk de realiteit. De vakbonden waarschuwen dat de sociale gevolgen veel groter kunnen zijn als er rekening wordt gehouden met het lokale industri\u00eble ecosysteem. Tychy werkt met tientallen onderaannemers en de volumedaling bedreigt een hele regio die al verzwakt is door eerdere herstructureringen in de Poolse auto-industrie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\"We voelen ons bedrogen<\/h2>\n\n\n\n<p>De toon van de vakbond is bijzonder hard. \"We voelen ons bedrogen\", zegt Grzegorz Maslanka, voorzitter van Solidarnosc in de fabriek. Volgens hem heeft de manier waarop het plan werd aangekondigd het vertrouwen tussen het management en de werknemers definitief geschonden. De vakbond beschuldigt Stellantis ervan geen echte vooruitgang te hebben geboekt in de onderhandelingen, ondanks verschillende formele bijeenkomsten. Maslanka waarschuwt dat de tijd nu tegen het bedrijf is. Als er binnen zeven dagen geen akkoord wordt bereikt, zullen er juridische stappen worden ondernomen. Een vooruitzicht met verstrekkende gevolgen voor een groep die in Europa al onder industri\u00eble en politieke druk staat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">De kern van het geschil: vrijwillig ontslag en schadevergoeding<\/h2>\n\n\n\n<p>De kern van het geschil is het vrijwillige-ontslagprogramma. Solidarnosc is van mening dat de voorwaarden die in Tychy worden aangeboden veel slechter zijn dan die in andere vestigingen van de Groep. Erger nog, de vakbond vreest dat de 'vrijwillige' aard van het programma slechts een fa\u00e7ade is, waarbij werknemers gedwongen worden te kiezen tussen een vertrek onder toezicht of een minder gunstig ontslag op een later tijdstip. Er is vooral onenigheid over de hoogte van de compensatie. De vakbonden eisen tot 36 maanden salaris, een niveau dat volgens hen overeenkomt met eerdere afvloeiingsplannen bij Stellantis. Het bedrijf stelt daarentegen een maximum van 24 maanden loon voor, gereserveerd voor de meest ervaren werknemers. De werknemersvertegenwoordigers vinden dit onaanvaardbaar, vooral voor werknemers die bijna met pensioen gaan of die de enige kostwinner in hun gezin zijn.<\/p>\n\n\n\n<p>Voorgestelde anci\u00ebnniteit en onbepaaldheden :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1 jaar - 5 maanden salaris,<\/li>\n\n\n\n<li>2 tot 3 jaar - 6 maandsalarissen,<\/li>\n\n\n\n<li>4 tot 8 jaar - 8 maandsalarissen,<\/li>\n\n\n\n<li>9 tot 10 jaar - 9 maandsalarissen,<\/li>\n\n\n\n<li>11-12 jaar - 12 maandsalarissen,<\/li>\n\n\n\n<li>13-14 jaar - 14 maandsalarissen,<\/li>\n\n\n\n<li>15-16 jaar - 16 maanden salaris,<\/li>\n\n\n\n<li>17-18 jaar - 18 maanden salaris,<\/li>\n\n\n\n<li>19 jaar - 20 maanden salaris,<\/li>\n\n\n\n<li>20-29 jaar - 22 maandsalarissen,<\/li>\n\n\n\n<li>meer dan 29 - 24 maanden salaris.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Stellantis blokkeert en ontkent elke blokkade<\/h2>\n\n\n\n<p>Toen Stellantis werd gevraagd naar deze escalatie van juridische procedures, verklaarde het bedrijf dat het in dit stadium officieel nog geen class action had ontvangen en ontkende het dat de besprekingen in een impasse waren geraakt. In een persbericht verklaarde een woordvoerder van de groep in Polen dat de onderhandelingen werden voortgezet \"om zo snel mogelijk de best mogelijke exitvoorwaarden voor de betrokken werknemers vast te stellen\". De groep verklaarde ook dat er ondersteunende maatregelen werden genomen, in samenwerking met lokale overheden en arbeidsbureaus, om de omscholing van de getroffen werknemers te vergemakkelijken. Dit is echter nauwelijks geruststellend voor de vakbonden, gezien de diepe kloof die nu tussen de twee partijen lijkt te bestaan.<\/p>\n\n\n\n<p>Afgezien van het Poolse geval, illustreert het geschil in Tychy de spanningen waarmee Stellantis momenteel te kampen heeft in Europa. De fabriek assembleert strategische modellen zoals de Alfa Romeo Junior, de Fiat 600 en de Jeep Avenger, die geacht worden de kernvolumes van de Groep te vertegenwoordigen.
